DECATUR, Ala. (AP) - A federal judge has ordered the arrest of an Alabama sheriff who was held in contempt of court for failing to adequately feed jail inmates while profiting from the skimpy meals.
U.S. District Judge U.W. Clemon ordered marshals to take Morgan County Sheriff Greg Bartlett into custody at the end of a hearing Wednesday in Decatur.

The sheriff had testified that he legally pocketed about $212,000 over three years with surplus meal money but denied that inmates were improperly fed. Alabama's unusual practice of letting sheriffs profit from feeding inmates dates back to the Depression.

Clemon, however, said the sheriff would be held until he comes up with a plan to provide the 300 jail inmates with nutrionally adequate meals, as required by an earlier court order.

Woman passes out beer to homeless, bites officer

Mesa, AZ - A 55-year-old woman bit a police officer after she was detained for handing out beer to needy clients at the Paz de Cristo community outreach ministry for the homeless, police said Tuesday.
According to police reports, staff members in the Paz de Cristo dining room asked Linda Lewis, 55, to leave while she was passing out soda Monday evening because she had a dog with her.
Lewis left, but pulled her vehicle up onto the sidewalk near the building in the 400 block of West Broadway Road, and returned with a case of beer, police said.
As Lewis was passing out beer to people around 6 p.m. she was told to leave by a police officer working at the location. She ignored his orders, popped open another beer and gave it away, police said.
The officer escorted Lewis out and explained to her the boundaries of the property. The woman continued to pass out beer outside of the building's block wall, police said.
Lewis was detained by police and searched by a female officer. During the search Lewis lunged forward and bit the officer's hand, police said.
Lewis was booked on charges of aggravated assault on law enforcement and criminal trespassing on a non-residential property.

Normal, Illinois Police release photos of armed bank robbery shot and fatally wounded by the police









A man suspected of robbing four banks died several hours after being shot by police following a high-speed chase around Normal in central Illinois.
Authorities say the man, identified by McLean County Coroner Beth Kimmerling as Robert Sylvester of Bloomington, robbed a Bloomington currency exchange at gunpoint on Monday and fled in his vehicle.

Police began a pursuit around 3 p.m. on Interstate 55. Authorities said the chase reached speeds of more than 90 mph. Witnesses say the 57-year-old Sylvester jumped out of the vehicle near the Peoria exit onto I-74 just north of Normal Community West High School. They say the man leaped over a concrete barrier and showed a gun.

That's when the suspect and officers from several jurisdictions exchanged gunfire and he was shot. Police said Slyvester was taken to BroMenn Regional Medical Center where he died late Monday.

Chicago reverses snow-clearing cutback on side streets
Citing neighborhood uproars, city no longer will spare the salt or plows

A declaration Tuesday by the Daley administration that it will restore aggressive snow- and ice-removal efforts led to expressions of relief from Chicago residents and the aldermen who often field their complaints.

In an effort to reduce overtime pay, city crews in early December waited until regular working hours before plowing side streets following a snowfall. But after the first couple snowstorms, temperatures plummeted and the resulting ice made side streets slick and treacherous.

"Unfortunately, it didn't work out very well," Streets and Sanitation Commissioner Michael Picardi told aldermen at a Tuesday hearing on the subject. "Now that we are in the extreme winter months of January and February, we know that we are going to have to plow and spread salt as we always have and as we did last year. So, we should expect then a significant increase in service on side streets in future snows."

Picardi, however, said waiting to plow side streets or not plowing at all could become an option in March if temperatures are expected to rise significantly the day after a snow.

From what I heard, all the Aldermen were pissed off beyond belief for not doing the plowing and salting the city usual does. All of their Aldermen ward offices were flooded with phone calls following each snow fall. Not to mention the tons of lawsuits already file for injuries and death resulting from the icy road conditions. For a city that produces billion of dollars in revenue each year, it is totally ridiculous not to plow and salt ALL the streets.

Sometimes when old Marines die they do fade away into unmarked graves in Potter's Field.
Such might have been the case for Gaspar Musso, USMC 925050, who fought in the Battle of Tinian in the Marianas Islands in 1944 and who died Nov. 15, at age 84 in a Brooklyn nursing home.
Enter Police Officer Susan Porcello, a PBA delegate at the 68th Precinct in Bay Ridge, and one of those big-hearted New Yorkers who still make this the best city on Earth.

"No way was I going to let this brave old Marine who fought for his country in WWII get buried in Potter's Field," she says.
Porcello first met Musso back in July when she responded to a 911 ambulance call to the retired insurance broker's one-bedroom apartment on, appropriately, Marine Ave.

"When my partner, Eddie Ennis, and I arrived at his apartment Gaspar seemed a little bit down about himself," Porcello says. "He said he felt alone in the world. We talked to him a bit and as I looked around his tidy apartment I noticed that he had served in the military - the Marines to be exact."

Porcello asked him about family and friends. "Look around you, what do you see?" Musso said. "I have no family or friends."

To which Porcello said, "Well, I'm your friend."

Right there, with those four beautiful words, Gaspar Musso was destined to die with the dignity he'd earned with a rifle in his hands, fighting in a USMC uniform, in a war that saved civilization.

If she didn't already wear a badge, you'd want to pin a star on Susan Porcello.

Musso, a diabetic with a host of other age-related maladies, had accidentally overdosed on his prescription medications. Porcello accompanied him to Lutheran Medical Center.

"I t old him I'd be back to visit him and take him to a senior center where he could make some friends," said Porcello, who comes from a big Italian family with a mom, dad, three sisters and a brother.

"I told him I was making him my 'Grandpa,' and if he liked, he could spend Thanksgiving with my family. Eddie and I discussed alternating holidays with Gaspar so he wouldn't be alone for any of them."

Two days later Musso was placed in critical care. Porcello asked hospital staff where he'd be buried if he didn't make it. "Potter's Field," said one administrator.

"This infuriated me," said Porcello. "There was no way I was going to let a man who fought for our country be buried in Potter's Field. Not on my watch!"

Porcello told the hospital to keep her apprised of Musso's condition. She had a local priest visit him. Porcello even asked NYPD's Missing Person's Squad to search for next of kin.

No luck.

Musso had been an only child to Anthony and Marie Musso, both deceased. He had no other relatives. Musso's only friend, an up stairs neighbor, had died the year before.

After his health improved, Musso asked Porcello to become his official health proxy.

She transferred him to Caton Park Nursing Home, where he was treated extremely well. She visited him often, learning that Musso was born May 7, 1924, joined the USMC in December 1943, finished training at Camp Lejune in March 1944 and was fighting with the 2nd Marines on Tinian Island by July 1944.

"I visited Gaspar on Nov. 13, bringing him rosary beads, a Bible, and his reading glasses," she said.

"The next day, Nov. 14, I returned and found Gaspar sitting up in a chair, dressed in his own clothes. Looking great."

Porcello washed his hands and face, trimmed his nails and eyebrows and asked if he was coming to her house for Thanksgiving. "I'm trying!" he said. He also asked Porcello to bring him a Christmas wreath for his room.

The next morning Porcello received a phone call saying that Gaspar Musso had died peacefully in his sleep.

No way was she going to let her good friend be toe-tagged and buried in Potter's Field.

Porcello paid out of her own pocket for a wake at McLaughlin's on Third Ave. and a mass at St. Patrick's Church in Bay Ridge, where a crowd of good-hearted cops from the 68th Precinct filled the pews, six serving as pallbearers. Sgt. Angel Rosa of the 68th, also a Marine, arranged for a USMC honor guard at Musso's funeral.

Then taps blew over Gaspar Musso, United States Marine, as he was buried next to his mother at Resurrection Cemetery in Staten Island.

With the dignity he deserved.

Fire at officer's home blamed on hatred of cops


It was no secret that Kelly Johnson was a police officer. She wore her Lynwood Illinois Police Department uniform when she left the house and often parked a squad car in her driveway.

Neighbors told her they felt safe when her squad car was there. But now the Lynwood patrol officer and her family don't feel secure anywhere after their home in Dyer, Ind., was destroyed in a fire.

The Dyer man charged in the arson allegedly stood and watched the fire and later told police he set the blaze, in part, because he doesn't like cops.

"We're supposed to be proud of what we do," Johnson said. "When someone like this uses it against you, it's just wrong."

To help the Johnson family, the Lake County, Ind., police department has started the Kelly Johnson Benefit Fund. The single mother was already scraping by since she had been on disability for several months because of a knee injury she sustained while answering a police call.

But now, the family has lost everything.

About 2 a.m. Dec. 20, a fire destroyed the Johnson house.

Johnson was not at home, but her three children--ages 11, 14 and 17--escaped with cuts, burns and smoke inhalation. The family's five dogs and cat died in the blaze.

Lake County Police Chief Marco Kuyachich, whose officers responded to the scene, said he wanted to help even though Johnson has no connections to the department.

"She lives in our community, and she's a police officer," Kuyachich said. "She's one of us. It upset me that her children had to go through this at a time when everyone else's children are enjoying the holiday."

Christopher Costello, 23, has been charged with three counts of attempted murder and one count of arson. Investigators first spoke to Costello the night of the fire when he was standing nearby watching the fire.

Two days later, investigators questioned him again. That's when he admitted to starting the fire with his Zippo lighter and a nearby trash can, Kuyachich said.

Costello told police that he set the fire because he was angry about being rebuffed by a woman at a nearby bar earlier that night, Kuyachich said. He said that he didn't like police officers and knew that a female police officer lived in the house.

He also said that he knew the children were inside and watched the fire burn for at least 15 minutes, Kuyachich said.

Johnson, a Lynwood police officer for six years, was nearby at a friend's house wrapping Christmas gifts. She said her children called her on her cell phone after they had escaped through windows.

The family is staying with relatives in the area so her children can continue to go to school. The insurance company is trying to find them temporary housing. And her children are trying to cope.

"It's bad enough that my children have dealt with me being in danger at work," she said. "Now they are afraid in their home. They are afraid they are going to be hurt."

Costello's attorney, Nick Thiros, declined to comment on the details of the case. Costello is still in jail after a Lake County judge ordered him held in lieu of $200,000. Thiros said he will ask the judge on Friday to reduce the bail.

The Chicago Way - Over priced items that the city doesn't need - Inspector: CPS espresso machines a waste

Chicago Breaking News - Tribune - One Chicago Public Schools manager must have really been jonesing for a cup of coffee when officials say she spent nearly $70,000 of the district's money to buy 30 cappuccino/espresso machines for a high school program.

But five months after the machines were purchased, 22 remained unopened, one disappeared and three were being used at two schools -- though not in the culinary arts program for which they were intended, the district's inspector general said today.

Officials in a department dealing with work-school programs allegedly separated the purchases to make them appear they came from 21 different schools and were under $10,000.

By doing so, the purchases did not have to be competitively bid or win school board approval, said Jim Sullivan, the district's inspector general.

As a result, he said, the district overpaid for the coffeemakers by more than $12,000.

"They sat unused for a number of months . . . by not letting the schools know they were coming, it turned out at the time to be a waste of money," Sullivan said.

The cappuccino caper was one of a record number of cases tackled between July 2007 and June 2008, Sullivan said.

The inspector general's office had 1,012 complaints alleging misconduct, waste, fraud and financial mismanagement in the district. Of these, 940 cases were closed with many resulting in recommendations for termination and some for criminal prosecution.

Following the investigation, the district has set up clearer guidelines to let school officials know that "stringing" purchases together is not allowed. A manager who oversaw the high school program and was involved in overseeing the cappuccino purchases has since resigned, but officials said it was a different employee than the one who did the purchasing.

Sullivan also said the district is trying to discipline two staff members at Rachel Carson Elementary School accused of falsifying records and using clout to get their children into the school despite designated attendance boundaries.

Three other employees since have resigned, Sullivan said.

The district ended up spending about $252,000 a year to bus as many as three dozen children to other schools when Carson, which at the time was their neighborhood school, filled up. Since then, the district changed the school to allow open enrollment across the city.

The inspector general's annual report also noted the district is trying to recoup nearly $460,000 in tuition from parents of students who attended the district but lived in the suburbs, Sullivan said.

This was done in a time when I personally know a few CPS teacher who have to spend their own money in order to purchase school supplies that the CPS should be purchasing. Amazing. And a 1/2 million dollars spent in education for students who are suburban residents? Here so many of us actual Chicagoans are sending our children to private schools at great cost and we have suburban kids sneaking into our CPS schools. I can only guess that these students come from the shittiest suburbs like Robins or Ford Heights and for them a CPS school is a step up. Maybe the Rev. Meeks can send the kids he was trying to enroll in nice suburban schools to the suburban schools that these suburban kids should of been going to.

Pima County seeks to install 20 speed traffic cameras - Sheriff Paul Babeu says they are not wanted and are money making scheme

TUCSON - Pima County officials want to install 20 speed-enforcement cameras to slow traffic, while neighboring Pinal County is pulling them because the new sheriff believes they are strictly used to make money.

Pima County supervisors are expected to vote next week on a proposal to deploy 10 fixed and 10 mobile speed-enforcement cameras. They would supplement cameras already used by the city of Tucson and a statewide program being implemented by the Arizona Department of Public Safety. Tickets would be processed by county Justice Courts.

Supervisors will consider the $1.5 million one-year contract with American Traffic Solutions Inc. of Scottsdale on Tuesday.

Meanwhile, new Pinal County Sheriff Paul Babeu had ended a contract with Scottsdale-based Redflex Traffic Systems Inc. to operate mobile traffic cameras in his county.
"I am against it, not only because I'm a strict constitutionalist, but I believe that the main purpose, is it's driven to create money for the government, in this budget deficit that's what the whole design is" Babeu said in a video shot by a group opposed to photo enforcement called CameraFRAUD and posted on its Web site on Friday. "It's corrupting law enforcement for us to be partnered with a private entity that creates revenue. Purely that's their interest.


"I've never yet seen a photo-radar camera arrest a drunk driver or arrest a person with a warrant, see if somebody has insurance or to just simply give directions to somebody, " Babeu said, adding that he supports red-light cameras because they are clearly safety related.

A DPS spokesman told KNXV-TV in Phoenix that Babeu is entitled to his opinion but DPS photo-enforcement operations will continue in Pinal County.

Babeu said he's hoping that incoming Gov. Jan Brewer will end the statewide photo enforcement.

The cameras are here strictly for revenue which are controlled by a private corporation with no over-sight. Theses privately ran corporations are awarded a bonus or commission based on revenue collected. Several communities have already caught these corporations playing with the timing of red lights and challenging the veracity of the tickets issued. And who are actually stuck paying these tickets? The poor working schmuck who actually has his license plates properly registered to their vehicle. The many of us who work the streets are fully aware that most ghetto owned vehicle have some kind of bullshit plate, temp. plate or out-of-state plate on their vehicles. I am aware that the Sheriff is against the speed cameras but is "OK" with red light cameras but I personally feel that all the cameras are just money making machines.


Driver warned of jail's sexual gorillas by Traffic Court Judge

SYDNEY (Reuters) – An Australian court has issued a blunt warning about the sexual predators a young driver faces in jail if he does not stop speeding, as authorities struggle to stop teenagers street racing.

"You'll find big, ugly, hairy strong men (in jail) who've got faces only a mother could love that will pay a lot of attention to you -- and your anatomy," said Magistrate Brian Maloney.

The 19-year-old male appeared in Sydney's Downing Center Court on Monday charged with driving without a license, failing to stop at a police alcohol check point and driving dangerously.

It was his third time before the courts for driving offences, prompting the magistrate's warning he would be jailed next time.

Maloney barred the teenager from driving until 2013, placed him on a 12-month good behavior bond and ordered him to do 150 hours of community work.

Breaching any of these conditions would see the teenager jailed where he would "shower with the gorillas in the mist down at Long Bay jail," said Maloney, his comments confirmed by the court on Tuesday.

"Out of control" was the frontpage headline in Sydney's The Daily Telegraph newspaper on Tuesday for a story on four teenagers either booked for street racing, speeding, driving without a license or crashing their car and killing a passenger.

The newspaper's editorial backed the magistrate's warning of life behind bars, saying his comments were "a vision in clarity" and gave the teenager "a reality check of his future."

"We can only hope this strategy helps. Hope it ends the slaughter of young innocents on the roads through stupidity...," said the Telegraph. "Road safety has become a war zone and any tactics are permissible..."

Police in the southern state of Victoria impounded 42 cars in the past six days after drivers were caught speeding.

One driver, aged 78, was clocked in Melbourne on New Year's Day at 170 kph (105 mph) -- 70 kph (44 mph) over the limit.

The 78-year-old was the "oldest hoon" in Victoria to have his car confiscated for speeding, local media said on Tuesday.

"It is disappointing to see a senior member of our community being so irresponsible," Acting Police Sergeant Carlo Visser told Melbourne's Herald-Sun newspaper.

"What example does this set for younger drivers?" said Visser.

sales. So they will know how much you buy and what calibers.
Nobody can sell any ammunition after June 30, 2009 unless
the ammunition is coded. Any privately held un-coded
ammunition must be destroyed by July 1, 2011.(Including hand
loaded ammo.)

They will also charge a.05 cent tax on every
round so every box of ammo you buy will go up at least $2.50
or more! If they can deprive you of ammo then they do not
need to take your gun!

This legislation is currently pending in 18
states: Alabama, Arizona, California, Connecticut, Hawaii,
Illinois, Indiana, Kentucky, Maryland, Mississippi,
Missouri, New Jersey, New York, Pennsylvania, Rhode Island,

Two legged ghetto Animal wanted for killing and dismembering good four legged animals!

FREEMONT, N.C. (WTVD) -- A Wayne County man is wanted for alleged animal cruelty.
Animal control officials are investigating what they say is a bizarre case involving dismembered animals.
Officers went to the home of Lawton Mckenzie after receiving a complaint. They found dismembered animals, a machete, knives, bowls of blood and what appeared to be a puppy's head in a plastic bag.
Animal control removed 26 living animals from the home. Officers also found a dying goat at the residence.
The goat, which was unable to move on its own, was transported to a veterinarian, who saved its life.
According to one officer, animal remains were being burned on a homemde grill. Investigators also found remains of a decapitated dog with its front paws cut off, dead snakes, a dead turtle, dead puppies and a goat head also on the grill.
Investigators also found owl remains among other unidentifiable items.
Mckenzie was in jail on unrelated charges and was bailed and then charged with animal cruelty. However, he is not in custody at this time

Babysitting a toddler becomes a dangerous occupation - Toddler Shoots Babysitter with a Shotgun For Stepping On Foot

JACKSON, Ohio (AP) -- Police say an angry 4-year-old Ohio boy grabbed a shotgun from a closet and shot his baby sitter. Nathan Beavers, 18, was hospitalized Sunday with minor wounds to his arm and side after the shotgun attack. Police say another teen was also injured.
Witnesses told police the child was angry because Beavers accidentally stepped on his foot. Beavers was watching the child at a mobile home in Jackson with several other teenagers and several other children.
Jackson County Sheriff John Shashteen says authorities are investigating. The child has not been charged.

$240,000 awarded to man forced to cover Arab T-shirt

NEW YORK (AFP) – An airline passenger forced to cover his T-shirt because it displayed Arabic script has been awarded 240,000 dollars in compensation, campaigners said Monday.

Raed Jarrar received the pay out on Friday from two US Transportation Security Authority officials and from JetBlue Airways following the August 2006 incident at New York's JFK Airport, the American Civil Liberties Union (ACLU) announced.

"The outcome of this case is a victory for free speech and a blow to the discriminatory practice of racial profiling," said Aden Fine, a lawyer with ACLU.

Jarrar, a US resident, was apprehended as he waited to board a JetBlue flight from New York to Oakland, California, and told to remove his shirt, which had written on it in Arabic: "We will not be silent."

He was told other passengers felt uncomfortable because an Arabic-inscribed T-shirt in an airport was like "wearing a T-shirt at a bank stating, I am a robber,'" the ACLU said.

Jarrar eventually agreed to cover his shirt with another provided by JetBlue. He was allowed aboard but his seat was changed from the front to the back of the aircraft.

Last week, nine Muslims, including three children, were ordered off a domestic US flight after passengers heard what they believed were suspicious remarks about security.

Although the passengers, eight of them US citizens, were cleared by the FBI, they were reportedly still barred from the AirTran flight.

Security has been at a high level in US airports since the September 11, 2001 hijacked airliner attacks against the World Trade Center in New York and the Pentagon in Washington.

However, rights groups and representatives of the Muslim community say the security measures have led to frequent discrimination and harassment.

The shooting death of a man in North Chicago early this morning was a police-involved shooting, the Lake County coroner said.
Coroner Richard Keller said the man was declared dead on the scene in the 1400 block of Glenn Driver in the northern suburb at 4:45 a.m.
He said the victim was black, but had no other information on his identity.
North Chicago police did not immediately return phone calls seeking information.

Man killed in crash of robbery getaway car 3 armed robbery suspects crash their get-a-way car after robbing store at 70th and South Pulaski Rd.
A man in his 20s died in a three-vehicle crash involving a car carrying three robbery suspects Monday, authorities said.
The unidentified man was declared dead at 6:04 p.m. Monday at Christ Hospital Medical Center in Oak Lawn following the crash, according to the Cook County medical examiner's office. It was unclear whether he was a suspect in the robbery or a victim in the traffic crash that followed it.
Three people robbed a retail store in the 7000 block of South Pulaski Road about 5 p.m. Monday and fled in an auto, according to police.
A short time later, the robbers' vehicle was involved in a crash with two other vehicles at California Avenue and Marquette Road, said police spokeswoman Sgt. Antoinette Ursitti.
All three suspects and two other people were taken to area hospitals from the traffic crashes, Ursitti said. Weapons and money were found in the suspects' vehicle, she said.
Area 1 detectives were investigating but would release no information.

Man found dead in southwest suburban woods
A man was found dead in a parking lot near a wooded area close to southwest suburban Willow Springs Tuesday morning.
The man, whose name was not immediately available, was found unresponsive in the Willow Springs Woods, according to the Cook County Medical Examiner’s office, which did not have his pronouncement information.
Early Tuesday morning, crews responded to a parking lot near the Willow Springs Woods for a hazardous materials incident, a Willow Springs firefighter said.
The incident occurred near the intersection of Willow Springs Road and Archer Avenue.
According to unconfirmed reports, a person was found unresponsive in a vehicle and a HazMat was called due to an unknown substance that was found in the vehicle.
A spokesman for the Cook County Forest Preserve police, who are handling the investigation, was not immediately available to comment.

WRONGFUL CONVICTION | Deal with city had Saturday deadline
Former Death Row inmate Madison Hobley will move to collect a $6.5 million legal settlement with the city now that the U.S. attorney's office hasn't indicted him in a 1987 arson fire that killed seven people -- including his wife and 1-year-old son.
Hobley served 13 years in prison for the arson before then-Gov. Ryan pardoned him in 2003.
Hobley claims former Chicago Police Cmdr. Jon Burge and others tortured him into confessing. He got a $1 million settlement from the city last year from a wrongful-conviction lawsuit.
In Hobley's unusual deal, the city announced a year ago that federal authorities had opened a new investigation into the arson and that Hobley could not collect an additional $6.5 million unless no indictment was brought against him by Saturday.
Randall Samborn, spokesman for the U.S. attorney's office, confirmed Hobley has not been indicted but would not comment on whether the fire investigation is continuing.
Hobley's attorney, Jon Loevy, said his client now lives out of state.
"Mr. Hobley is innocent, and we were absolutely confident there would be no indictment," Loevy said. "We are pleased prosecutors have apparently recognized that."
Several Hobley family members have been subpoenaed in the probe, Loevy said.
At his murder trial, Cook County prosecutors contended Hobley set the apartment fire to get rid of his wife so he could continue an affair with another woman. In his defense, Hobley accused Burge and others of torturing a confession out of him.
Burge now awaits a federal criminal trial for allegedly lying in his response to the lawsuit filed by Hobley. Burge said he and other detectives didn't torture anyone.

Two stabbed outside Lincoln Park bar

Chicago, IL - An alcohol-fueled brawl that started inside a crowded bar spilled outside, leaving two young men hospitalized with stab wounds early Tuesday in the Lincoln Park neighborhood on the North Side.

At 12:40 a.m., a group of young men were drinking inside the Irish Eyes tavern, 2519 N. Lincoln Ave., where a small fight began. They left and the fight apparently became physical because police found a few drops of blood outside the bar, according to Belmont District police.

The fracas eventually moved across the street and about 4 doors north of the bar where two men, possibly originally from the suburbs and between the ages of 18 and 22, were stabbed with a knife at 2546 N. Lincoln Ave. where the “bulk” of the blood was found, police said.

One injured man was transported to Advocate Illinois Masonic Medical Center in critical condition where he remains as of 4:30 a.m. and the second one suffered a stab wound to his arm and was initially taken to St. Joseph Hospital but was later transferred to Advocate Illinois Masonic Medical Center, according to police, who said the man initially taken to St. Joseph was not as seriously wounded as the other man.

Police could not say whether the men involved are students or what the fight was about as the men and about 10 witnesses provided many different versions of what triggered the fight.

Police have not ruled out the possibility that the men stabbed each other.

Belmont Area detectives are investigating.

Minn. board certifies Franken as leader at end of recount, but Coleman plans legal challenge

ST. PAUL, Minn. (AP) — A Minnesota board on Monday certified results showing Democrat Al Franken winning the state's U.S. Senate recount over Republican Norm Coleman, whose lawyer promised a legal challenge that probably will keep the race in limbo for months.

The Canvassing Board's declaration started a seven-day clock for Coleman, the incumbent, to file a lawsuit protesting the result. His attorney Tony Trimble said the challenge will be filed within 24 hours. The challenge will keep Franken from getting the election certificate he needs to take the seat in Washington.

"This process isn't at an end," Trimble said. "It is now just at the beginning."

Franken, a former "Saturday Night Live" personality, ended the recount up by 225 votes, an astonishingly thin margin in a race where more than 2.9 million votes were cast.

Slaying of Metra officer: Suspect charged in 2006 shooting death


Police officer was killed for his gun, authorities say

For more than two years, the fatal shooting of Thomas Cook, a police officer for Metra, had remained a mystery, but on Monday authorities charged one of two suspects and alleged that Cook was killed for his gun.

Jeremy Lloyd, 20, of Gary acted as a lookout while an accomplice shot the officer in the back of the head at point-blank range and stole his service weapon, authorities alleged. Lloyd was ordered held without bail on three counts of murder. Authorities gave no explanation for why the alleged gunman was not charged Monday.

Cook's brother, Robert, a Cook County sheriff's deputy, said the family was relieved by Lloyd's arrest and looked forward to his trial.

"We're happy it's got to this point," he said. "We've gotten to first base; we're just to the bond hearing. Home plate is the sentencing."

Thomas Cook had been a Riverdale police officer for nine years but left for the Metra police force in 2003 because he thought it would be safer.

Shortly before 10 p.m. on Sept. 27, 2006, Cook, 43, married and the father of two young children, was sitting in his marked Metra squad car conducting surveillance near the crime-ridden Metra Electric Line station at 147th Street in Harvey.

Lloyd and his accomplice had lost weapons during a shootout with a Harvey police officer early that morning, authorities alleged. As they walked down an alley near the train station, they talked about how they needed to "do a lick [robbery] to get another gun," Assistant State's Atty. Joe Kosman said in court.

Kosman said the accomplice suggested they rob a Metra cop, reasoning that a police officer would be sure to have a weapon. While Lloyd looked for other police, the accomplice walked up to the driver's side window of Cook's car, shot him twice in the head and stole his .357-caliber semiautomatic handgun, Kosman said.

A witness met the accomplice later that night and traded a weapon for Cook's gun, officials said. The officer's gun was recovered in Robbins in August 2007 and traced back to that witness, Kosman said.

Lloyd also told a second person to watch the news for a police officer shooting in Harvey, and when the person later confronted him about the news reports, Lloyd allegedly admitted his role in the slaying, authorities said.

Both Lloyd and his alleged accomplice are in Cook County Jail awaiting trial on charges of attempted murder and aggravated discharge of a firearm stemming from the shootout with the Harvey police officer hours before Cook's murder.

Jemetric Nicholson, 21, of Harvey, was charged with Lloyd in the attempted murder of the Harvey officer, court records show. He is awaiting trial on nearly a dozen violent crimes, including an unrelated murder.

Robert Cook said he never stopped believing the case would be solved. "They've been as frustrated as we have because the pace hasn't been that fast," he said. "We didn't give up hope."

WAKE COUNTY (WTVD) -- Some Wake County parents plan to voice their concerns at a meeting Monday.
Parents of more than 25,000 Wake County students are upset about the school district's latest school reassignment proposal.
Some have even worked on alternatives they say could help meet criteria set by school authorities. At the same time, school leaders say the plan is what's best for the county.
Parent Barbara Walsh has a son starting high school soon in Wake County and her preference for him is Apex High School.
"The balance of the people on our street, the children his age or just a year ahead, are all going to Apex High School and will be going to Athens High School," Walsh said.
Her concern comes after checking out the Wake County school system's latest reassignment plan.
Among the reasons cited by school authorities for moving students like Walsh's son, is the desire for economic diversity across the county's classrooms. But Walsh says that goal is met right now, in many cases.
"Our base elementary schools are both Title I schools. They have 40% free and reduced lunch, so experiencing diversity at Athens High school is not going to be anything new for our children," Walsh said. "In fact, they have a lower free and reduced number than our elementary and middle schools do."
She says mobile units should provide enough room for more low income students next year, without moving her son and other students who like the school.
"So I think that would be a good compromise, in elevating diversity at Apex High School," Walsh said. "I don't see, and I don't understand, moving children from one set of mobile unites at Apex High School to another set of mobile units at Athens High School."
Walsh says her main concern is what she calls "double reassignment."
She fears that the students moved from apex to Athens High will be assigned to Apex High three years later when western Wake County gets a new high school.
The public meeting is Monday evening at 6:30 p.m.

A long story short on this news is that the US Supreme Court, through recent decisions, have basically ruled that "bussing" students for the purpose of racial diversity was unconstitutional. This news story come from Raleigh-Durham, NC.

So if schools cannot bus students for the sole reason of racially diversifying schools... the schools had to come up with a new reason to bus students so they can have the racial breakdown they want at their individual schools. What is the new solution? Bussing students so that the schools are "economically diverse". So effectively what you have is the same old program that has been ruled unconstitutional by the US Supreme Court under a different name.

So let’s just say there is a nice high school a few blocks from your home. Close for your child to attend, in a safe area and without the need to place your child on a school bus to be driven across the city. But wait! You and your spouse are working, earning an income and going to work EVERY DAY. Well since you live in a neighborhood that doesn’t have ghetto baby’s mommas in every other Section 8 house, your child has to go to the ghetto school to make room for that welfare baby at the school a few blocks from your house.

If you don’t think that one day soon, the working people of this country are going to have that straw placed on their back that breaks the donkey’s back…maybe think again.

Navy to commission new aircraft carrier - George H.W. Bush CVN-77 - Named for the 1st President Bush


USS George H. W. Bush (CVN-77) is the tenth and last Nimitz class supercarrier of the United States Navy. She is named for former President George H. W. Bush, who was a naval aviator during World War II. George H. W. Bush is to be the final Nimitz class aircraft carrier constructed; the next carrier built will be Gerald R. Ford Template: WP Ships USS instances, the first of a new class.

She is the second United States aircraft carrier to be named after a naval aviator. Other naval vessels named for aviators include frigates McCluskyTemplate:WP Ships USS instances and ThachTemplate:WP Ships USS instances, and destroyer MasseyTemplate:WP Ships USS instances, all named for aviators who commanded formations in the Battle of Midway. George H.W. Bush is also the second aircraft carrier, following Ronald Reagan, to be named after a living former President. While still a Nimitz class ship, George H. W. Bush differs significantly from her predecessors, even more so than the differences between CVN 68–70 and CVN 71–76.

Construction began in 2001 by the Northrop Grumman Newport News shipyard, at a cost of $6.2 billion. The aircraft carrier was christened on 7 October 2006, and delivery is set for 2009. She left Northrup Grumman Ship Building on 23 December 2008 and is scheduled to be commissioned 10 January 2009.

3 Illegal Alien Lettuce Picking Teenagers charged in car window-breaking spree - 27 car windows shattered


Three 18-year-olds were charged this afternoon with criminal damage to property, accused of driving down two streets in the Southwest Side's Gage Park neighborhood busting 27 car windows with a "blunt object," police said.

Just before 9 a.m. today, officers responded to calls from residents of the 5700 and 5800 blocks of South Francisco and Fairfield Avenues and found more than two dozen parked vehicles with broken windows when they arrived, police said.

Witnesses gave them a description of the vehicle whose occupants shattered the windows and officers stopped the car in the 2500 block of West 55th Street, about a mile away.

Police identified the three teens in the vehicle as Roy Hernandez, of the 5400 block of South Sawyer Avenue; Mike Peralta, of the 5500 block of South Washtenaw Avenue; and Alberto Jaime of Palos Park.

Each has been charged with one count of felony criminal damage and an additional 26 counts of the misdemeanor form of the same charge.

Illegal Alien Lettuce Picker runs out of gas after shooting at another vehicle


Authorities have charged a driver they suspect fired shots at another vehicle this morning on U.S. Interstate 57, then abandoned his car when it ran out of gas and walked to a house in Midlothian.
The shooting occurred at about 3 a.m. today on I-57 south of 167th Street in southern Cook County. Two men, ages 21 and 19, headed to work in a pickup truck had just exited U.S. Interstate 80 and were headed north when a black Pontiac sedan pulled along their passenger side.

"At some point they heard a sound and thought that the individual [in the sedan] had thrown something at them," said Illinois State Police Master Sgt. Anthony Hoop. Actually, the other driver had leaned out the window and fired several shots at the pickup with a handgun, Hoop said.

The Pontiac then exited at 167th Street and the two men in the pickup, who were unhurt, called police. State troopers located the sedan soon after, abandoned on 167th Street just past the off-ramp from the highway.

The driver "ran out of gas," Hoop said, "and just left the vehicle there."

Officers traced the car's registration to a house in the 14900 block of Keeler Avenue in Midlothian, about 2 1/2 miles north of the car. At about 4 a.m., they arrived at the address, Hoop said, and while they were speaking with the home's residents they saw the suspect walking in a hallway.

The man, identified as Oscar Villarreal-Gomez, 30, was arrested and a handgun recovered, along with shell casings from the Pontiac, Hoop said. Police found a bullet hole in the right-side bed of the pickup truck.

Villarreal-Gomez, of the 300 block of Eaton Avenue in Romeoville, was charged with two counts of aggravated discharge of a firearm at an occupied vehicle and another count of unlawful use of a weapon.

Asked by police why he fired on the other vehicle, he replied that he was "highly intoxicated," Hoop said. "He gave an indication that these guys were messing with him."

Authorities intend to charge a 20-year-old Gary, Ind., man with first-degree murder in connection with the shooting death of Metra Police Officer Thomas Cook in a train station parking lot in Harvey over two years ago.
A source close to the investigation told the Tribune that the man was scheduled to appear for a bond hearing Monday morning. Court records show he is currently in jail awaiting trial on an unrelated attempted murder charge, from less than two months after the Sept. 27 2006 slaying of Cook, 43, of Dyer, Ind.

The Tribune is not naming the man because it was unclear tonight whether he had been formally charged.

The source said the man and an accomplice were driving around on the night of the killing searching for someone to rob of a gun. They saw Cook's squad car parked in the lot of the Metra Electric Line station at 147th Street, walked to the vehicle and shot the officer at pointblank range, then took his gun, the source said.

The South Suburban Major Crimes Task Force and Metra police will hold a news conference at 2 p.m. Monday at the Riverdale Police Department, according to a statement.

Wisconsin identifies the three subjects killed when two snowmobiles crash into each other.

ARBOR VITAE, Wis. -- Authorities in northern Wisconsin's Vilas County have released the names of three people who died in a snowmobile crash.
Officials say Sunday that the victims are 26-year-old Jennifer M. Kender of Racine, 26-year-old Nathan J. Kender of Racine, and 39-year-old Scott J. Sumoski of South Elgin, Ill.
Sheriff's officials say the accident was reported about 10 a.m. Saturday in the town of Arbor Vitae. The two snowmobiles had crashed on a trail, killing both drivers and a passenger.
Authorities did not indicate who was driving. The state Department of Natural Resources and the Vilas County coroner are investigating.

Reporting from Portland, Ore. -- For years, Oregon has been diligent about reducing the state's dependence on fossil fuels, but its environmental consciousness has come at a stunning price -- gas tax revenue is down $4.8 million a year compared with 2006.

That drop, caused by lower fuel consumption and a slowing economy, has prompted Oregon to consider a new way to pay for road repairs: Democratic Gov. Theodore R. Kulongoski's upcoming budget calls for a highway tax based on mileage, not gasoline purchases.


A state task force will look at equipping every new vehicle in Oregon with a Global Positioning System to record every mile driven and where. Motorists would pay at the gas pump based on how much they drove, no matter how fuel-frugal their vehicle.

The plan still requires legislative endorsement and the full details could take several years to work out, but state analysts said the governor's endorsement is a crucial step toward solving what has become a problem in many states: dependence on a gasoline tax.

"This is a way to try to develop a fair funding mechanism that we're going to have to have if we're going to be aggressive in terms of looking at electric cars and hybrids and plug-ins and all those options, and at the same time continue to invest in our roads and infrastructure," said Rem Nivens, the governor's deputy communications director.


Oregon plans to spend $650 million on transportation projects next year, a smaller version of President-elect Barack Obama's proposal to stimulate the economy with infrastructure spending. Here, it will be financed in part by a 2-cent-a-gallon tax increase.

Jim Whitty, manager of the state transportation department's office of innovative partnerships and alternative funding, said the state already faces a $10-billion shortfall in financing transportation projects, and the number will climb unless the decline in gas tax revenue is addressed.

Only a major rethinking of highway finance can keep Oregon from running seriously short of transportation funding as early as next year, state officials say.

While Oregon appears to be out in front in looking at a mileage fee, several other states, including Ohio, Pennsylvania, Colorado, Florida, Rhode Island, Minnesota and Texas, have also expressed an interest in phasing out the gas tax in favor of charging motorists for how much they drive.

In Oregon, some drivers protest that the plan would discriminate against rural residents who may have to drive several miles just to get to the grocery store; create potential inequities compared with drivers from out of state; and raise privacy concerns, with Big Brother keeping a satellite watch over where everyone is driving.

"What's next? Tattoo numbers on your forearm?" wrote one commenter at Oregon Catalyst, a conservative website.

Jason Williams, executive director of the Taxpayer Assn. of Oregon, said: "This is just another wide-eyed government experiment that's going to fail and cost the taxpayer a lot of money. We basically see it as the next big boondoggle of 2009."

While the GPS mileage-counters could be programmed not to regularly report a vehicle's location, that wouldn't entirely eliminate privacy concerns, Williams said. "The fact that they tag your car to a certain place at a certain time means they're tracking your movements. So what happens in a divorce court when the wife tries to track where her husband was, or a boss tries to make sure you were where you were supposed to be?"

Some Oregon businesses have been eager to take advantage of the state's substantial tax credits for shifting to energy-efficient vehicles. The governor's proposal to expand the tax credit for electric cars to up to $5,000, combined with new federal subsidies, could allow Oregonians to save up to $12,500 on the purchase of an all-electric car.

Portland's Hot Lips Pizza already has converted five of its 14 delivery vehicles to all-electric, "and we're looking at definitely increasing that number," in part because some customers now specify that they want their pizza delivered in an electric car, said Lou Hijar, director of operations.

He said the company has not calculated how a mileage fee rather than a gas tax would affect its expenses, but is ready to look at the proposal. "We're always looking for the better mousetrap," he said.

State officials say they are committed to minimizing concerns about privacy and about inequity before implementing any mileage-based idea.

In a Portland trial program in 2006 and 2007, about 300 cars were equipped with GPS devices and every time drivers bought gas, they were charged 1.2 cents a mile -- about equivalent to the state's 24-cents-a-gallon tax assuming a vehicle that averages 20 miles per gallon.

"They drive up to the pump and there's a mileage reader there, very much like a modern toll reader, which identifies the car as a mileage fee payer, and the total mileage driven in each zone is transferred by a wireless radio frequency that goes into a database, and the mileage fee rates are applied," Whitty said.

In Kulongoski's proposal, GPS devices would be installed only in new vehicles, and would monitor mileage only on Oregon roads. Drivers from outside the state would pay the standard gas tax, Whitty said.

The monitors could also allow the state to charge higher fees for rush-hour travel in congested areas, Oregon officials say. Seattle recently conducted such a trial with GPS and found that drivers were much less likely to enter congested areas when charged to do so.

California has also looked at mileage fees, but "we're still talking. We're not there yet," said Elizabeth Deakin, professor of city and regional planning at UC Berkeley.

She said the increasing variation in vehicles' fuel efficiency has impelled the national debate over how to pay for transportation expenses.

"A vehicle that gets 20 mpg pays more gas tax, but doesn't actually use that much more road than my hybrid does," she said. "I'm not paying much gas tax. I'm getting kind of a free ride. Of course, you can say that's not a bad thing, because it gave me an incentive to pay more money for the hybrid."

Mileage fees don't have to involve GPS trackers, Deakin said. They could be as simple as submitting periodic odometer readings -- when renewing car registration, for example -- or setting an estimated average that everyone would pay. (In the latter scenario, drivers could be invited to prove they drove less, and car sellers could be charged if their odometer readings were higher than they should be.)

Whitty acknowledged that he thinks Oregon "won't be able to complete this without assistance from the federal government, or a consortium of other states," because of such complications as the GPS cost to manufacturers for cars sold in Oregon; the likelihood that some Oregonians would just go out of state to buy cars without the GPS; and the potential inequity with drivers from out of state.

"We know what we need to do," Whitty said.

"Now the other states have to decide whether they want to use our system or try their own."

The state could just charge for mileage based on the vehicle's odometer reading alone. And save billions of dollars on all the GPS unit that would have to be installed. West suburban police are looking for two people involved in "numerous vehicle burglaries and credit card frauds."
According to a release from Naperville Crime Stoppers, images of the two suspects were caught on camera at a SuperTarget store at 1951 W. Jefferson Avenue in the suburb. Credit cards from one burglary were used about 5 p.m. Dec. 23 at the SuperTarget.
The suspects are described as a heavyset black male with a goatee and partial beard and a white female about 20-30 years old, standing about 5-3 to 5-5 with a thin build and blond/brown shoulder-length hair.
Naperville police told the Chicago Sun-Times that the two are wanted for a about a half-dozen crimes in the suburbs, including Warrenville, Joliet and Streamwood.
Crime Stoppers is offering a reward of up to $1,000 for anyone who can deliver information leading to an arrest of the two suspects. The phone number to call is 630-420-6006.

Richardson pulls nomination to Obama Cabinet amid grand jury probe "Pay to Play" (Like Blago)

WASHINGTON - President-elect Barack Obama suffered the first blow to his Cabinet on Sunday as his commerce secretary-designate, Gov. Bill Richardson, withdrew from consideration, citing an investigation of a company's business dealings with the state government he leads.

The New Mexico governor said in a statement released Sunday afternoon that he was withdrawing because the investigation would have "forced an untenable delay in the confirmation process."

"A pending investigation of a company that has done business with New Mexico state government promises to extend for several weeks or, perhaps, even months," Richardson said, without further identifying the subject of the investigation.

Richardson asserted that he had "acted properly in all matters and that this investigation will bear out that fact."

A federal grand jury in Albuquerque has been investigating how Beverly Hills, Calif.-based CDR Financial Products won state contracts that generated more than $1.5 million in fees after donating $100,000 to political organizations affiliated with Richardson.

The probe is part of a national investigation of "pay-to-play" practices in the municipal bond market, in which financial companies make political donations to office-holders in order to be considered for government business.

Obama said in a statement that he accepted Richardson's withdrawal "with deep regret."

"It is a measure of his willingness to put the nation first that he has removed himself as a candidate for the Cabinet in order to avoid any delay in filling this important economic post at this critical time," Obama said.

The withdrawal of a Cabinet nominee comes as Obama travels to Washington today for the start of pre-inaugural talks with legislative leaders.

Cops: 3 babies found in filthy West Side apartment

Two women and a man were arrested Saturday night on the West Side after Chicago police found three babies in what officials described as a filthy apartment with rats and roaches.

Latrice Johnson, 23, and Kevin Wysinger, 21, were each charged with three misdemeanor counts of endangering the life of a child and three misdemeanor counts of contributing to the neglect of a child, officials said. Shirley Fenner, 21, was charged with one misdemeanor count each of endangering the life of a child and contributing to the neglect of a child.

The three adults, who told police they lived in the apartment, are parents of at least one of the children, but police were not saying who is related to whom to avoid identifying the children.

The babies, a 16-month-old boy, 14-month-old boy and 4-month-old girl, were taken to Norwegian-American Hospital for observation. Police said they were later turned over to the Illinois Department of Children and Family Services who subsequently placed them in the care with other family members.

Police responded to a 911 call for a domestic disturbance at the apartment in the 600 block of North Spaulding Avenue (map) about 9:35 p.m., they said this morning.

Once inside the apartment, officers found Johnson and Wysinger. There was no heat in the unit, and there were roaches, rats, numerous open containers of alcohol, exposed electrical wires and an overflowed toilet with human waste, police said. There was also no food or water in the unit, they said.

The boys, who were wearing winter coats when found by police, were then taken away from the apartment and Johnson and Wysinger were taken into custody.

In the meantime, assisting officers stuck around the apartment to wait for evidence technichians to arrive. About a half-hour after Johnson and Wysinger were arrested, police said, the officers heard noises coming from a bedroom.

That's where they discovered the baby girl hidden on the floor behind a mattress that was propped vertically against a wall, police added.

Shortly thereafter, Fenner arrived at the apartment. And when police found out she was a parent of one of the children, she was arrested.

"When you think you've seen it all. ... it's shocking and appalling," said Harrison District Lt. John Andrews. "If it were not for the alertness of the officers at the scene, this 4-month-old baby could have died."

Andrews couldn't specify for how long the children lived under the poor conditions in the apartment, but said, "We don't get ... total squalor in 24 hours."

Shirley Johnson, Latrice Johnson and Shirley Fenner's mother, said this afternoon the apartment is hers and her daughters don't live in the apartment. Nor do the three babies, she added.

Instead, they and Kevin Wysinger were visiting Saturday night when someone called police because Latrice Johnson and Wysinger, who are girlfriend and boyfriend, were arguing, she said. The children were never left alone, she said.

Shirley Johnson, 44, acknowledged the apartment does not have running water nor a working toilet, but said Chicago police's description of their residence was wrong.

She showed a Tribune reporter and photographer around the apartment, and no rats and roaches, nor animal droppings, were observed.

"You don't see no roaches because it's cold," she said.

The kitchen entrance was closed off with a sheet and Shirley Johnson said the kitchen had no power, but the family does have food, she said, pointing to a pot of chicken giblets cooking on an electric hot plate.

Shirley Johnson also disputed a police account that the infant girl was hidden on a floor behind a mattress. She showed a reporter a small bedroom separated from the living room by a sheet and pointed to a twin mattress laying flat on the floor, covered with several sheets and blankets. She said the baby was sleeping on the bed.

"She wasn't behind no bed," Shirley Johnson said.

The misdemeanor charges against Johnson, Wysinger and Fenner could be upgraded to felonies pending the outcome of the investigation, which is being handled by detectives from the Harrison Area special victims unit.
